From what Glocktor said, the games theme this time is apparently "Nature vs. Genetics", so Mewtwo having a new forme would sort of make sense, but its still extremely absurd for a 1st gen Cockfighting Society to get a brand new forme this time around.

Phione being a legendary is very debatable. You forgot Heatran. Also, get Raikou and Darkrai off that list! The idea of Raikou on a weird design list for Legendary Mons is sickening to me.
