It's at this point where this crosses over into authoritarianism. While that was a very bad joke and shouldn't have been made, it's the parent's job to raise their kids not to devour beating hearts, not the government's.
Only thing this prison sentence would do is to expose a young individual to dangerous people, provide a terrifying experience and frighten people into not expressing themselves.

Not to mention, as someone said in the comments, he'd be in prison for the most critical years of his adult life if convicted, which would leave him with no job skills, little education, and overall a great formula to actually start committing crimes just to survive.
