I just talked to her again. The paper SPECIFICALLY SAID she would get expelled if it wasn't completed.
Absolutely not.Supaaku wrote:I assume she'll be paid for her efforts?

I would expect materials such as paint and brushes would be provided.
If it's something she's going to be graded on I don't see what the problem is.
I would personally find it an exciting thing to do.

The problem is that the school is taking advantage of her to get work done for free using threats.DoNotDelete wrote:I would expect materials such as paint and brushes would be provided.

That's something to show to a legal expert because it is highly illegal. Contracts made under duress can be voided.
Stuff goes here later.
Re: All topics unimportant enough to not create a thread for
Yeah. She may want to have a lawyer look over the contract in that case. Forcing someone to do a service under threat of expulsion can't be legal. Especially if not paid for the service done.

Ah, found my book of business law. Mostly deals with contracts so here we go, something your friend will really like Sax.
A contract made under duress to property and economic duress is voidable. The injured party can choose to affirm or rescind it within a reasonable amount of time. However, for contracts entered into under duress to person, the contract is void at the start and is treated as if there was no contract at all.

But does that then mean that all her education (and grades) under that contract are also null and void - meaning she's screwed if she does the mural and screwed if she argues the contract is null and void?

It is not for school.
She paints it or gets expelled.
And this is on top of all her other work.
Also I should have mention that this is a highschool student.

If it's not part of her education/grading then she should question it, yeah.
But really a mural is not a big deal; Just paint the wall black and stencil a skull onto it using some vector art lifted from the net and some spraycans.

Re: All topics unimportant enough to not create a thread for
I don't think so. I recall something to this instance, let me look it up. Chances are if it's a separate paper then it's not part of her education and is a separate contract though.DoNotDelete wrote:But does that then mean that all her education (and grades) under that contract are also null and void - meaning she's screwed if she does the mural and screwed if she argues the contract is null and void?
Also Sax your friend has an incredibly easy out if she's a minor. A minor legally cannot be bound by a contract, not even with parental consent. They are able to disaffirm the contract at any point before their 18th birthday and it is rendered void. Even if they already received their benefit, they are under no obligation to repay it.
Only use that if the mural is not part of the education contract though. Check if they're separate, because voiding affects the whole contract.

And then there will be some bullshit about more detail or something.DoNotDelete wrote:If it's not part of her education/grading then she should question it, yeah.

And the fact that she will get expelled, as in she will never be able to attend the school again and will have to move to another town with a highschool, the closest being 2 hrs away.
I'd like to point out that this is the same school system that is changing to 6 day cycles.
No semesters, just all your classes in one long year and all your exams at once.
No parent board approval required.
I'm glad I've already graduated.

I am so glad I'm not part of that school system. That has to be the most bassackwards way of doing things I've ever heard.saximaphone wrote:And then there will be some bullshit about more detail or something.DoNotDelete wrote:If it's not part of her education/grading then she should question it, yeah.

Okay, man, Sax, don't bite my head off.
So now you gotta make sure this isn't part of her grades - and if it isn't she can challenge it - like Madican has said.
If it is part of her grades she's just gonna have to do it.
